Terms of service
Last updated 19 October 2026
This text is a draft under legal review and is not yet in force. It describes how we intend to work at launch.
These terms are an agreement between you (or the organization you represent) and Orchec (“Orchec”, “we”, “us”) for the use of the Orchec service, its dashboard, API, CLI, MCP server and agent (together, the “Service”).
1. Your account
You must give accurate details when you create an account and keep your sign-in methods secure. You are responsible for everything done through your account, including by people you invite and by API tokens you create. Tell us at once at security@orchec.com if you think your account has been compromised.
2. Your servers and data
You keep all rights to your servers, applications, code and data (“Customer Data”). You give us permission to process Customer Data only to run the Service for you, as described in the data processing agreement.
The Orchec agent runs on servers you choose and acts only on operations you or people you authorize start, including plans proposed by the AI copilot and approved by a person. You are responsible for what you ask the Service to do to your servers, and for keeping backups of data that matters to you.
3. Acceptable use
You must follow the acceptable use policy. We may suspend access that puts the Service, other customers or third parties at risk, and we will tell you why when we can.
4. Plans, billing and refunds
Paid plans are billed in advance in US dollars through Stripe, which adds applicable taxes at checkout. Extra servers are prorated. Upgrades apply at once; downgrades apply at the end of the billing period. If a payment fails, we retry three times over 7 days; after that, management actions pause until payment succeeds. We never stop your servers because of billing. Data is kept for 90 days after an account closes.
You may cancel at any time. The refund policy explains refunds within 14 days of your first payment.
5. AI features
AI features answer questions and propose changes. They can be wrong. Every change they propose is shown as a plan for a person to approve before it runs, and the AI acts only with the permissions of the person who asked. You are responsible for reviewing plans before you approve them.
6. Availability and changes
We work to keep the Service available and secure. Enterprise plans include an uptime commitment for the control plane in their contract. We may change or retire features; we will give notice of material changes that reduce what a paid plan includes.
7. Confidentiality and security
We protect Customer Data with the measures described on our security page and in the data processing agreement, and we do not use Customer Data to train AI models.
8. Liability
To the extent the law allows, the Service is provided “as is”, and each party’s total liability under these terms is limited to the amount you paid us in the 12 months before the claim. Neither party is liable for indirect or consequential losses. Counsel to confirm the final wording and any exclusions required by local law.
9. Ending the agreement
You can close your account at any time. We may end these terms if you materially breach them and do not fix the breach within 30 days of notice. After closing, you can export your data for 90 days, after which we delete it.
10. General
These terms are governed by the laws named in your order form or, if none, by the laws of the State of Delaware, USA. Counsel to confirm. If we change these terms, we will post the new version here and tell account owners by email at least 30 days before material changes take effect.
